Mediation as an alternative or complement to traditional criminal justice proceedings is growing in many states. Variously described as community justice, restorative justice, informal justice etc., in practice it is most commonly referred to as mediation. Mediation unites those those who want to strengthen the position of victims, those who seek alternatives to punishment, and those who want to reduce the expenditure and workload of the criminal justice system , and make it more efficient and effective. This recommendation and explanatory note set out guiding principles to be considered in the development of existing schemes, as well as the introduction of new ones. The legal safeguards of the parties in cirminal justice processes, as laid down by the European Convention on Human Rights, are emphasised.
